TERMS OF USE AND STATEMENT OF AGE FORM

In order to use the INSEX ARCHIVES.com Site (“Site”), you must purchase a ticket and
register as a member of the Site (“Member”) and agree to be bound by these Terms of
Use (“Agreement”). Read these Terms of Use, and then fill out the form and sign it to
indicate your acceptance of the Agreement. This Agreement sets out the legally binding
terms for your membership.
  1. Eligibility. You must be over the age of consent for your particular community, state, or nation to use the Site. By using the Site, you represent and warrant that you have the right, authority, and capacity to enter into the Agreement and to abide by all the terms and conditions of this Agreement. This Agreement may be modified by INSEX ARCHIVES.com from time to time, effective immediately upon notice to you.
  2. Term. This agreement will remain in full force and effect while you use the Site and/or are a Member. You may terminate your membership at any time, for any reason on receipt by the Site of your written or email notice of termination. INSEX ARCHIVES.com may terminate your access to the Site and membership at any time for any reason. If membership is terminated by either party for any reason, you will not be entitled to any refund. Even after this Agreement is terminated, certain provisions will remain in effect including sections 4, 5, 7, 8-14, inclusive, of this Agreement.
  3. Non Commercial Use by Members. INSEX ARCHIVES.com is for the personal use of individual Members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members of the Site and may not use the Site for any purpose. Illegal and/or unauthorized uses of the Site will be investigated, and appropriate legal action will be taken.
  4. Proprietary Rights in Content on INSEX ARCHIVES.com. INSEX ARCHIVES.com owns and retains other proprietary rights in the Site. The Site contains copyrighted material, trademarks, and other proprietary information of INSEX ARCHIVES.com. Except for the information which is in the public domain or for which you have been given permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell such proprietary information.
  5. Content Posted on the Site. You understand and agree that INSEX ARCHIVES.com may delete any messages or photos (collectively, “Content”) that in the sole judgment of INSEX ARCHIVES.com violate the Terms of Use or might be offensive, illegal, or annoying. You are solely responsible for the Content that you publish on the site or transmit to other Members.
  6. Disclaimers. INSEX ARCHIVES.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, problems or technical malfunctions of any telephone network lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet. The Site is provided “AS-IS” and INSEX ARCHIVES.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. INSEX ARCHIVES.com does not promise any specific results from the use of the Site.
  7. Limitation of Liability. Except in jurisdictions where such provisions are restricted, in no event will INSEX ARCHIVES.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site, even if INSEX ARCHIVES.com has been advised of the possibility of such damages.
  8. Indemnity. You agree to indemnify and hold INSEX ARCHIVES.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above or any violation of state or federal law or regulation.
  9. Adult Content. You agree that you acknowledge that you are entering an online web site, which contains information of an adult nature and subject matter, which might depict sexual activity and erotic art.
  10. Community Standards. You agree that the viewing, reading, and/or downloading of sexual information from this online service, whether deemed pornographic, obscene or prejudiced in other ways by acts of law and force do not violate the community standards of you or your locality, city, town, county, state, province, country or other community to which you belong.
  11. False Statements. You agree that you are wholly liable for any false disclosures and responsible for any legal ramifications that may arise from the viewing, reading, or downloading of images, information or material contained within this service.
  12. Fraudulent Use. You agree that you indemnify producers, sponsors, and internet service providers against any and all claims that may arise as a result of fraudulent entry or illegal use of this service and material contained therein.
  13. Agreement to Terms and Statement of Age. You agree that you have read the above disclaimer in its entirety, agree to its conditions, are of legal age, and that it is not a violation of the law applying to your area of access to view the material contained within.
  14. Other. This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the INSEX ARCHIVES.com service, contains the entire agreement between you and INSEX ARCHIVES.com regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
  15. Availability of Service. You accept that INSEX ARCHIVES.com makes no guarantee that Site will be available for Members to access. In the event of bankruptcy, legal problems, technical problems, outside interference, or other unforeseen developments, the Site may be temporarily or permanently unavailable. You understand that no refund will be issued, regardless of the availability of the Site.

Once you have filled out this order form, return it and your completed and signed copy of the TERMS OF USE AND STATEMENT OF AGE form along with cash (Dollars or Euro equivalent), check or money order to the following address. Payment: We accept cash, checks and money orders. Checks and money orders should be made out to “Intersec Europe”. In the case of personal checks, tickets for new members will not be issued until funds clear. Tickets for existing members will be extended on good faith until such faith is abused. Cash should be placed in an opaque security envelope. We have never had an issue with receiving cash in the mail, so if possible, please use Dollars or Euros if possible, rather than checks or money orders.
